Collaborative Wavy Baby by MSCHF and Tyga Resembles the Vans Old Skool

A court is now ordering MSCHF to stop selling the Tyga x MSCHF Wavy Baby after Vans filed a lawsuit on April 15th. Vans accuses MSCHF of copying its Old Skool silhouette and is therefore suing the company for trademark infringement, false designation of origin, unfair competition, and trademark dilution. The Tyga x MSCHF Wavy Baby was released in April and sold out within an hour.

"MSCHF, in collaboration with Mr. Stevenson (Tyga), shamelessly marketed the Wavy Baby shoe to confuse consumers, unlawfully deprived Vans of sales, and intentionally damaged Vans' valuable intellectual property rights," the lawsuit states. Evidence presented by Vans' lawyer Lucy Wheatley includes a video of Tyga microwaving a pair of Old Skool sneakers, turning them into Wavy Baby shoes, and social media comments from people who believed the MSCHF sneakers were an official Vans collaboration.

"They're wavy, they're wobbly, and you can't just skateboard in them," argued MSCHF lawyer Megan Bannigan. While the company's creative director has admitted that the 1977 Vans Old Skool design served as inspiration for his shoe, he sees the Wavy Baby as a larger commentary on big brands and consumerism.

While the case is pending, MSCHF is prohibited from selling the Wavy Baby shoe, given Vans' valid arguments.

Judge William F. Kuntz's ruling also states, "The Court specifically notes the striking visual similarities between the Old Skool shoes and the Wavy Baby shoes and their respective packaging. The brands need not be identical, only similar, for there to be a likelihood of confusion."

After MSCHF released the controversial Air Max 97 "Satan" that caused a lot of trouble, a new sneaker that fans can actually buy is dropping. This wavy MSCHF Wavy Baby was designed with rapper Tyga, and it looks a lot like the Vans Old Skool. Here are the details.

You can't deny the resemblance, as the upper and sole are very reminiscent of Vans' classic. The Tyga x MSCHF Wavy Baby has a black upper, which is refined with white contrast stitching and stripes of the same colour. In between, the white laces and insoles also provide contrast, while the heels come with red patches.

However, the Tyga x MSCHF Wavy Baby has been altered so that the entire upper and sole feature a distorted design. The latter is very eye-catching because of the large indentations. In addition, there are big warning signs at the bottom, stating that MSCHF is not liable for any injuries that may occur from wearing the Tyga x MSCHF Wavy Baby shoe.
